新疆快递服务业监管法律制度研究

新疆快递服务业监管法律研究 　　　　摘要 　　自 1986 年新疆邮政首先开办 EMS(邮政特快专递)业务以来，在二十八年的时间里，新疆快递行业从无到有，总体规模迅速增长。据新疆维吾尔自治区邮政管理局的不完全统计显示，目前全疆从事快递服务的企业已发展到近百家。新疆快递行业正形成由国有、民营和外资企业三足鼎立的市场格局，新疆快递行业具有良好的发展前景。在新疆快递行业发展的过程中逐渐暴露出诸多监管方面的问题亟待解决。 　　本文由四个章节构成：第一章“快递行业的概述”。主要阐述快递、快递行业基本概念的界定，分析快递企业经营模式，为新疆快递行业监管法律制度的思考提供理论基础。第二章“新疆快递行业监管法律制度的现状和存在的问题”。通过新疆快递行业存在的问题及新疆快递行业的立法现状和执法现状，突出反映新疆快递行业在监管过程中存在的问题。第三章“外国快递行业监管法律制度综述及借鉴”。这一部分内容比较分析了美国、德国和英国的快递行业监管法律制度，并从中得到了对新疆快递行业监管的启示。第四章“完善新疆快递行业监管法律制度建设的思考”。新疆快递行业的发展具有很强的优势，需要从政府监管部门、社会的快递行业监管和企业内部监管三方面的具体措施来完善新疆快递行业监管法律制度。 　　关键词：新疆维吾尔自治区；快递行业监管；法律制度 　　Abstract 　　Since 1986, first launched in Xinjiang Post EMS (Express Mail Service) business since,at the time twenty-eight years, Xinjiang courier industry from scratch, the rapid growth of theoverall size. Incomplete statistics show autonomous Postal Service is currently engaged inexpress delivery services company in Xinjiang has grown to nearly one hundred. Xinjiangcourier industry is formed by a state-owned, private and foreign market structure three pillars,Xinjiang courier industry has good prospects for development. In the process of developmentin Xinjiang courier industry gradually revealed many regulatory problems to be solved. 　　This paper consists of four chapters: the first chapter, "Overview of the courier industry."Mainly on the courier, the courier industry to define basic concepts, analysis courier businessmodel to provide a theoretical basis for thinking about the courier industry in Xinjiang LegalSystem. The second chapter, "the status quo and problems of Xinjiang courier industryregulatory legal system." By courier industry problems in Xinjiang and Xinjiang legislativestatus quo situation and enforcement of the express industry, highlights the courier industry inXinjiang problems in the regulatory process. Chapter 3, "foreign legal system courier industryregulatory review and learn from." Comparative analysis of this part of the United States,Germany and the UK courier industry regulatory legal system and derive the inspiration forthe courier industry in Xinjiang regulation. Chapter 4, "Xinjiang perfect the legal systemcourier industry regulatory thinking."
