电信设备进网管理办法 工业和信息化部 电信设备进网管理办法 (2001年5月10日中华人民共和国信息产业部令第11号公布。根据2014年9月23日中华人民共和国工业和信息化部令第28号公布的《工业和信息化部关于废止和修改部分规章的决定》修正) 第一章 总 则 第一条 为了保证公用电信网的安全畅通，加强电信设备进网管理，维护电信用户和电信业务经营者的合法权益，根据《中华人民共和国电信条例》，制定本办法。 第二条 本办法所称电信设备是指电信终端设备、无线电通信设备和涉及网间互联的设备。 电信终端设备是指连接在公用电信网末端，为用户提供发送和接收信息功能的电信设备。 无线电通信设备是指连接在公用电信网上，以无线电为通信手段的电信设备。 涉及网间互联的设备是指涉及不同电信业务经营者的网络之间或者不同电信业务的网络之间互联互通的电信设备。 第三条 国家对接入公用电信网的电信终端设备、无线电通信设备和涉及网间互联的电信设备实行进网许可。 实行进网许可制度的电信设备必须获得工业和信息化部颁发的进网许可证;未获得进网许可证的，不得接入公用电信网使用和在国内销售。 第四条 实行进网许可制度的电信设备目录由工业和信息化部会同国务院产品质量监督部门制定和公布。 第五条 电信设备生产企业(以下简称生产企业)申请电信设备进网许可必须符合国家法律、法规和政策规定。申请进网许可的电信设备必须符合国家、通信行业标准以及工业和信息化部的规定。电信设备生产企业应当具有完善的质量保证体系和售后服务措施。 第六条 生产企业申请电信设备进网许可，应当附送国务院产品质量监督部门认可的电信设备检测机构出具的检测报告或者认证机构出具的产品认证证书。 periodically check the security system, check the special process with implementation of the permit system. 5, security responsibilities should be strengthened on the construction site, as well as camp hygiene, food hygiene, public fire safety and other aspects of the work of the management, to prevent all accidents from happening. 6, in the construction area, the signs should be set to minimize the construction of pedestrian interference, pay attention to safety. In the main construction sites, job 志;不符合条件的，书面答复生产企业。 第十条 生产企业通过质量体系认证的，其提供检测机构检测的样品由生产企业按规定数量自行选取。 生产企业未通过质量体系认证的，其提供检测机构检测的样品由省、自治区、直辖市通信管理局按工业和信息化部规定的抽样办法执行。 第十一条 申请进网许可的无线电通信设备、涉及网间互联的设备或者新产品，应当在中国境内的电信网上或者工业和信息化部指定的模拟实验网上进行至少三个月的试验，并由试验单位出具试验报告。 工业和信息化部电信管理局组织专家对前款电信设备总体技术方案、试验报告、检测报告等进行评审，根据专家评审，经审查符合条件的，颁发进网许可证。 第十二条 生产企业对获得进网许可证的电信设备进行技术、外型改动的，须进行检测或重新办理进网许可证。 对获得进网许可证的电信设备外型改动较小，生产企业要求减免测试项目的，可以将改动前后的照片、电路原理图、改动说明和改动后的样品等交检测机构进行审核。检测机构向工业和信息化部电信管理局出具审核意见，检测机构审核认为可以减免测试项目的，经工业和信息化部电信管理局同意，可以减免测试项目。 第十三条 实行进网许可制度但尚无国家标准、行业标准的电信新设备，由生产企业自行将样品送到检测机构，检测机构根据国际标准或者企业标准进行检测，并出具检测报告。 工业和信息化部电信管理局对检测报告和有关材料进行审查，在符合国家产业政策和不影响网络安全畅通的条件下，批准进网试验，待国家标准、行业标准颁布后再按程序办理进网许可证。 第十四条 我国与其它国家或地区政府间签署电信设备检测实验室和检测报告相互认可协议的，按协议规定执行。 第三章 进网许可证和进网许可标志 第十五条 生产企业应当在其获得进网许可的电信设备上粘贴进网许可标志。进网许可标志由工业和信息化部统一印制和核发。进网许可标志属于质量标志。 未获得进网许可和进网许可证失效的电信设备上不得加贴进网许可标志。 第十六条 进网许可证和进网许可标志不得转让、涂改、伪造和冒用。 第十七条 进网许可证的有效期为3年。 periodically check the security system, check the special process with implementation of the permit system. 5, security responsibilities should be strengthened on the construction site, as well as camp hygiene, food hygiene, public fire safety and other aspects of the work of the management, to prevent all accidents from happening. 6, in the construction area, the signs should be set to minimize the construction of pedestrian interference, pay attention to safety. In the main construction sites, job 业和信息化部规定。检测机构或产品质量认证机构及其工作人员不得弄虚作假，不得利用职务之便剽窃或泄露生产企业的技术秘密。 第五章 罚 则 第二十八条 违反本办法规定，销售未获得进网许可的电信终端设备的，由省、自治区、直辖市通信管理局责令改正，并处1万元以上10万元以下罚款。 第二十九条 违反本办法规定，伪造、冒用、转让进网许可证，编造进网许可证编号或粘贴伪造的进网许可标志的，由工业和信息化部或者省、自治区、直辖市通信管理局没收违法所得，并处违法所得3倍以上5倍以下罚款;没有违法所得或者违法所得不足1万元的，处1万元以上10万元以下罚款。 第三十条 违反本办法规定，生产企业获得进网许可证后降低产品质量和性能的，由产品质量监督部门依照有关法律法规予以处罚。 第三十一条 违反本办法规定，生产企业未在获得进网许可的设备外包装和刊登的广告中注明进网许可证编号的，由工业和信息化部或者省、自治区、直辖市通信管理局责令改正，并给予警告。 第三十二条 违反本办法规定，生产企业有下列行为之一的，由工业和信息化部或者省、自治区、直辖市通信管理局责令限期改正;情节严重的，给予警告: (一)申请进网许可时提供不真实申请材料的; (二)不能保证电信设备获得进网许可证前后的一致性的; (三)售后服务不落实，对国家规定包修、包换和包退的产品不履行相应义务的; (四)不按规定参加年检或者年检结果不合格的; (五)不接受工业和信息化部对电信设备获得进网许可证前后的一致性组织进行的监督检查或者检查结果不合格的。 违反前款第一项规定，尚未取得进网许可证的，工业和信息化部不予受理或者不予许可，生产企业在一年内不得再次申请进网许可;已取得进网许可证的，工业和信息化部撤销进网许可证，生产企业在三年内不得再次申请进网许可。 第三十三条 违反本办法规定，电信业务经营者拒绝用户自备的获得进网许可的电信终端设备进网的，由省、自治区、直辖市通信管理局责令改正，并向电信用户赔礼道歉，赔偿电信用户损失;拒不改正并赔礼道歉、赔偿损失的，处以警告，并处1万元以上10万元以下的罚款;情节严重的，责令停业整顿。 第三十四条 违反本办法规定，对已获得进网许可证的电信设备进行重复检测、发证的，由工业和信息化部责令改正。 第三十五条 违反本办法规定，检测机构、产品质量认证机构有下列行为之一的，工业和信息化部对其出具的检测报告或认证证书不予承认: periodically check the security system, check the special process with implementation of the permit system. 5, security responsibilities should be strengthened on the construction site, as well as camp hygiene, food hygiene, public fire safety and other aspects of the work of the management, to prevent all accidents from happening. 6, in the construction area, the signs should be set to minimize the construction of pedestrian interference, pay attention to safety.
