Perfect village 50%,待拆迁完成50%时～乙方再支付30%,待拆迁完成后10个工作日内～乙方一次性付清余款。 第三条 拆迁补偿费用 依据洛阳市西工区洛北乡西小屯村民委员会、东涧沟村民委员会分别与上海升龙投资有限公司签订的《合作协议书》的～经甲方以双方协商～乙方按《合作协议书》约定时间和方式向甲方支付下列费用: 1、乙方按总承包确定的安臵面积288000平方米～每平方米每月8元的标准支付临时安臵补偿费。2、村民搬迁补助费按总承包确定的安臵面积288000平方米～每平方米每次8元的标准～按两次计算。3、村民搬迁奖励费按总承包确定的安臵面积288000平方米～每平方米45元的标准。4、村集体建筑搬迁补助费100万元包干。5、过渡期村集体收入补助费按每年总额600万元包干。6、改造范围内所有拆迁房屋装修补偿按2400万元总承包。其中:住宅房屋装修补偿按2000万元总承包。非住宅房屋装饰装修补偿按400万元总承包,含村集体企业、村非住宅房屋、教堂、学校、派出所、城建教育中心、康乐食品厂,。7、教堂、学校、派出所、城建教育中心、康乐食品厂搬迁补助费、搬迁费、奖励费等100万元包干。 第四条 连同该项目一并改造的周边国有土地房屋拆迁安臵由甲方负责报洛阳市人民政府批准～享受城中村改造拆迁安臵房建设的各项优惠政策。 第五条 甲方在2009年9月底前完成本项目土地公开转让的各项报批准备工作。甲方同意依照国家和洛阳市的相关规定～将上述土地已法出让～乙方按《合作协议书》第十八、十九、二十条的约定承担土地出让费用外～甲方不再收取任何其他土地转让费用。自乙方支付村民过渡费之日起～180天全部完成该改造项目土地范围内所有建筑取得拆迁工作～并将建筑垃圾清运至原建筑物地面标高经平整后的场地交给乙方。逾期甲方未完成该改造项目土地范围内所有建筑物的拆迁工作并向乙方移交所有土地～乙方停止支付临时安臵补助费。 第六条 为保障村民安臵房建设的顺利进行～甲方同意成立“洛阳市 building, improving overall quality. Strengtoriented and t-Is team- 2 - 西小屯,东涧沟,村安臵房建设指挥部”～负责监管安臵房的设计、施工发包等工作。协议双方确认～改造范围内全部安臵房建设任务由乙方承担。协议双方另行签订安臵房委托建设协议～民却各自应履行的权利和义务。 第七条 甲乙双方应开设“西小屯、东涧沟村改造资金银行专用账户”并及时签订《资金共同监管协议》～以便双方对“西小屯、东涧沟村改造资金银行专用账户”资金共同实施管理。国有土地使用权出让乙方摘牌成功后～乙方分两期向甲乙双方共管的“西小屯、东涧沟村改造资金银行专用账户”汇入安臵房建设保证金2亿元人民币～首期保证金1亿元,含乙方已支付的拆迁补偿费用,于乙方国有土地使用权出让摘牌成功后10天内汇入～第二期保证金1亿元乙方国有土地使用权出让金缴讫后10天内汇入。保证金用于支付安臵房建设用地出让金、临时安臵补助费、搬迁补助费、装修补偿非、搬迁奖励费及安臵房工程建设费用。 第八条 乙方缴纳的本项目安臵区用地补办出让手续土地出让金、商品房开发区土地出让金～在扣除上缴河南省政府资金和10%廉租房保障资金后～所缴纳的土地出让金剩余部分～在市财政按规定拨给西工区人民政府后～区政府全额拨给西小屯、东涧沟村改造资金银行专用账户～按《资金共同监管协议》规定的用途使用。 当三方约定的上述资金全额拨付到账并全部按《资金共同监管协议》规定的用途使用后～安臵房建设资金不足部分～全部由乙方承担。上述资金未拨付到账得差额部分造成安臵房建设资金的不足～乙方不予承担。由甲方自行承担。 第九条 甲方同意～当西小屯村委会未能按《合作协议书》的约定及时向乙方支付代为增建的5000平方米商业面积的费用时～乙方应从甲方支付的西小屯村村民临时补助费和过渡期村集体收入补助费中扣除人民币2000万元,当东涧沟村委会未能按《合作协议书》的约定及时向乙方支付代为增建的2000平方米商业面积的费用时～乙方应从甲方支付的东涧沟村村民临时补助费和过渡期村集体收入补助 g the construction of grassroots party organizations and party members. Strengtoriented and t-Is team- 4 - 见证方:洛阳市人民政府 地址:洛阳市开元大道 法定代表人:郭洪昌 洛阳市人民政府市长 为做好洛阳市西工区洛北乡西小屯村改造项目的相关工作～确保项目开发建设工作的顺利进行～根据《中华人民共和国合同法》、《中华人民共和国土地管理法》、《中华人民共和国城乡规划法》、《城市房地产管理法》、《村民委员会组织法》等国家有关法律法规和《洛阳市人民政府办公室关于印发洛阳市26个城中村开发改造实施意见的通知》,洛政办[2008]50号,～甲、乙、丙三方本着平等合作、互惠互利的原则～经友好协商～在洛阳市人民政府的见证下～就项目合作相关事宜～达成如下协议: 一、项目概况 第一条、洛阳市西工区洛北乡西小屯,东涧沟,村改造项目～位于洛阳市西工区洛北乡～总建设用地面积约为388亩～最终以洛阳市国土资源局出让面积为准。甲方需要拆除地上建筑物面积约为26.54万平方米～其中村民住宅约23.38万平方米,其中村民住宅两层以下合法有效建筑面积及钻探公司、汉屯小学住宅面积约17.5万平方米,～村集体用房约2.87万平方米～汉屯小学教学楼0.2万平方米～教堂建筑0.09平方米。本项目通过整体改造～建成一个集商贸、酒店、服务、高档住宅等功能为一体的商务社区。 第二条、本项目由乙方独立开发经营～总投资人民币约35亿元～乙方自行承担和享有开发经营风险和权益。甲方及甲方村民按照本协议享有拆迁安臵、经济补偿等相关权益～不承担开发经营风险和收益。 第三条、按照洛阳市人民政府颁发的《洛阳市人民政府办公室关于印发洛阳市26个城中村开发改造实施意见的通知》,洛政办[2008]50号,及相关文件的规定～丙方确认该项目享受洛阳市城中村改造各项优惠政策～具体但不仅限于为: 1、本项目享受洛政办[2008]50号文件所规定的各项优惠政策。丙方负责请示市政府批准行文完整列出本项目必须缴纳且不可减免的费用、可免交各种费用、可减交的各种费用及减交比例清单。 building, improvin-g the construction of grassroots party organizations and party members. Perfect village- 5 - 2、丙方负责向市政府正式行文将本项目列为洛阳市重点工程项目、保证本项目的年度开发规模～协调市房管局提供办理商品房欲售许可证的一切便利条件。 3、土地出让金分三批缴纳～每批缴纳后市财政应在10个工作日内及时按洛政办[2008]50号规定全额拨付～用于被拆迁村民的补偿安臵。 二、项目的拆迁、补偿和安臵 第四条、洛阳市西工区洛北乡西小屯村改造项目用地范围内村民和村集体的所有建筑物采取一次性整体搬迁～被拆迁村民和村集体临时自行过渡～被拆迁村民按本协议的规定领取临时安臵补助费、搬迁补助费、附属物及装修补偿费、搬迁奖励费。 第五条、项目临时安臵补助费、搬迁补助费、搬迁奖励费 附属物及装修补偿费的补偿标准: 1、临时安臵补助费按甲、乙双方确定的建筑面积175000平方米～每平方米每月8元的标准发放。 2、村民搬迁补助费按甲、乙双方确定的建筑面积175000平方米～每平方米每次8元的标准～按两次计算～一次性发放。 3、搬迁奖励费按甲、乙双方确定的建筑面积175000平方米～每平方米45元的标准发放。 4、附属物及装修补偿费按洛阳市拆迁补偿标准发放。 第六条、首次支付临时安臵补助费时间为本协议生效且在村民代表大会讨论通过拆迁补偿、丙方上报的本项目修建性详细规划经市规划局批准后5日内。首次支付金额为6个月的临时安臵补助费。此后乙方每半年支付一次6个月临时安臵补助费。每次应于每个半年到来前10日内支付～最后一次支付如遇实际过渡期不到半年的～按实际剩余过渡时间支付～临时安臵补助费截至到安臵房交付的当月。 甲方未按照本协议第十三条的约定在180天内完成全部拆除工作并向乙方移交本项目所有土地～乙方停止支付临时安臵补助费直至甲方完成全部拆迁工作并向乙方移交本项目所有土地当日止。 -embers. Perfect village- 6 - 搬迁补助费、搬迁奖励费乙方与首次支付临时安臵补助费并一次性全额向丙方支付。 乙方将上述款项汇入丙方指定账户～丙方须开具税务部门认可的收款票据～并负责及时向甲方村民发放上述费用。 第七条、临时安臵补助费自甲方村民搬迁腾空房屋交付拆除之日当月发放。拆迁过渡期不超过30个月～自乙方依法获得商品房开发用地国有土地使用权～且安臵房建设用地交地后从甲方同意安臵房设计方案之日算～截至时间为安臵房全部交付的当月。 第八条、因拆迁村集体资产而造成过渡期村集体收入损失～由乙方按每年总额400万元包干予以补偿～乙方每半年支付一次～首次支付时间为应拆除的村集体建筑面积全部拆除之日后10日内。今后每次应于每个半年到来前10日内支付～最后一次支付如遇实际过渡期不足半年的～按实际剩余过渡时间支付。过渡期村集体收入补助费自应拆除的村集体建筑面积全部拆除之日当月起计算～截至到村集体商业安臵房交付的当月。 第九条、甲乙双方确认西小屯村民安臵房原则上全部在该村王城大道以东地块安臵。甲乙双方确认西小屯村民住宅安臵房的安臵面积超过该村王城大道以东地块政府批准的住宅建设面积时～经过乙方同意后～超过部分与东涧沟村村民住宅同址安臵。两村具体的安臵面积、界址划分由丙方负责确定～与乙方无责。 甲乙双方同意安臵房为高层框剪结构～为确保安臵房,含商业房,的工程质量、工期～甲方及丙方委托乙方承建所有的安臵房。安臵房的户型设计由乙方提供方案～经甲乙双方协商同意后实施。 第十条、安臵补偿 依据原有的房屋性质和用途分别进行补偿。补偿方式以产权调换的方式进行。其中: 住宅房:村民被拆迁住宅房屋主体二层,含二层,以下合法有效建筑面积,含钻探公司及汉屯小学住宅,按1:1计175000平方米予以同建筑面积在双方确认的安臵地块进行房屋产权调换安臵:其余建 ely prthe new and improved the regulation, the town village appraisal methods, training of party members and other 8 work, effectivhe cadres, and improve the overall quality of party members and cadres. Second, strengthenin- 7 - 筑面积按4.5平方米拆迁建筑面积折算成1平方米安臵房建筑面积计13067平方米进行产权调换安臵。村民住宅沿街现有的商业用房一律按住宅补偿。 非住宅房:乙方补偿甲方村集体非住宅房的总建筑面积确定为35000平方米。其中地面以上建筑面积25000平方米,按一、二、三、四层按垂直投影1:1:1:1的比例分配,～地下室建筑面积10000平方米。 本条所确定的住宅安臵建筑面积数、村集体非住宅安臵房建筑面积数～系本协议附图所标明改造范围内所有建筑物拆除后乙方应补偿的全部安臵房建筑面积数。 安臵区的社区配套、物业管理用房不计入村集体非住宅安臵房范围～乙方按照洛阳市的相关规定建设后无偿交付甲方使用。 为保障甲方改造后村集体收入的稳步提高～应甲方要求并经甲乙双方协商～乙方同意代为甲方在安臵地块按地面一、二、三、四层垂直投影1:1:1:1的比例～增建5000平方米的商业用房～甲方同意按每平方米建筑面积4000元人民币向乙方支付建设费用～建设费用甲方须在乙方交房前12个月一次性付清～丙方为此向乙方保证～甲方逾期未付～丙方保证代甲方全额付清并承担连带责任。 为保障改造后甲方村集体收入的稳步提高～经甲乙双方协商～乙方同意全部租赁甲方所有权地面以上商业面积～租期20年。起始租金每月每平方米人民币20元,含税,～免租金期12个月～以后按照每五年递增10%比例计算。具体租赁事宜双方另订协议。 第十一条、安臵住宅房的交房条件和标准甲乙双方另行商定作为本协议的附件～与本协议具有同等的法律效力。村集体安臵非住宅房的交房标准为外装修完成的毛坯房～公共部分内装修由乙方承担～其余部分内装修由甲方自行承担。 第十二条、甲方、丙方确保本项目所有安臵房的房屋产权办证完全享受“洛政办[2008]50号”文件所规定的免交房屋修缮基金等各 building, improving overall quality.
