Sports Modernization and Sports Legal Construction in China

Abstract: For the past over 30 years of reform and opening to the outside world, sports in China,
especially the competitive sports, have made great progress, yet there still exist some shortcomings in the
development of sports. In order to realize the sustainable development of the sports in China, we must
change our mindset and the ways of development and establish a modern sports management model. Since
the issue of the Sports Law of the People’s Republic of China in 1995, the sports legislation in China has
made tremendous progress. But we are still lagging behind in some fields and we are slow in response in facing
the new problems cropped out in the course of sports socialization and industrialization. Therefore, social
management and market management are the important directions for us to enhance sports legislation. The
administrative authorities should lay emphasis on the two points of right and order so as to perfect sports
legislation and relief mechanism. Sports arbitration has become a hot topic in the researches on sports law
and sports system construction in China. Some arbitrators from China have been involved in the arbitration
cases of CAS. The establishment and development of international sports arbitration have perfected the
international sports order and also help perfect the sports relief mechanism in different countries.
