江西省计划生育管理条例 江西省人口与计划生育条例 中国网 | 时间: 2002-10-23 | 文章来源: 国家计生委网站 (2002年7月29日江西省第九届人民代表大会常务委员会第三十一次会议第三次修订) (1990年6月16日江西省第七届人民代表大会常务委员会第十五次会议通过，1995年6月30日江西省第八届人民代表大会常务委员会第十六次会议第一次修订，1997年6月20日江西省第八届人民代表大会常务委员会第二十八次会议第二次修订，2002年7月29日江西省第九届人民代表大会常务委员会第三十一次会议第三次修订) 第一章总则 第一条为控制人口数量，提高人口素质，实现人口与经济、社会、资源、环境的协调发展，推行计划生育，维护公民合法权益，促进家庭幸福与社会进步，根据《中华人民共和国人口与计划生育法》以及其他有关法律、行政法规的规定，结合本省实际，制定本条例。 第二条户籍或者居住在本省行政区域内的中国公民、本省行政区域内的机关、社会团体、企业事业组织，应当遵守本条例。 第三条实行计划生育是国家的基本国策。公民有合法生育的权利，也有依法实行计划生育的义务。夫妻双方在实行计划生育中负有共同的责任。公民实行计划生育的合法权益受法律保护。 鼓励公民晚婚晚育，提倡一对夫妻生育一个子女;符合本条例规定条件的，可以要求安排生育第二个子女。 第四条开展人口与计划生育工作，应当坚持与发展经济、帮助群众勤劳致富、建设文明幸福家庭相结合，坚持与增加妇女受教育和就业机会、增进妇女健康、提高妇女地位相结合。 开展人口与计划生育工作，应当依靠宣传教育、科技进步、综合服务，建立健全奖励和社会保障。 第五条各级人民政府及其工作人员在推行计划生育工作中应当依法行政，文明执法，不得侵犯公民的合法权益。 从事计划生育工作的人员依法执行公务受法律保护。 第六条各级人民政府应当将人口与计划生育事业费纳入本级财政预算，并逐步增加投入，增长幅度应当高于财政收入的增长幅度，保证计划生育工作的正常开展。 任何单位和个人不得截留、克扣、挪用人口与计划生育工作经费。 县级以上人民政府对贫困地区开展人口与计划生育工作应当给予重点扶持。 鼓励社会团体、企业事业组织和个人为人口与计划生育工作提供捐助。 第七条工会、共青团、妇联和计划生育协会等社会团体、企业事业组织和公民应当协助人民政府开展人口与计划生育工作。 第二章生育调节 第八条实行计划生育证制度。凡要生育的夫妻，应当申请领取计划生育证: (一)生育第一胎的，在分娩前，凭结婚证、户口簿，以及夫妻双方单位或者所在村(居)民委员会的证明，经一方户籍所在地的乡(镇)人民政府或者街道办事处审核，发给《一胎生育证》; (二)夫妻婚后满5年未怀孕，经县级以上人民政府卫生行政部门指定的医疗、保健机构with effective measures. Intelligent retrieval system to support video content enhancements, can be used for video content by keyword, key features of the automatic search, image and video search feature and video display. 鉴定一方患不孕症，依法收养子女后又怀孕并要求生育的，按本款第一项的规定申请领取《一胎生育证》; (三)符合本条例第九条规定申请再生育一胎的，凭夫妻双方单位或者所在村(居)民委员会证明以及结婚证、户口簿和生育情况等相关证明材料，经乡(镇)人民政府或者街道办事处审核，报女方户籍所在地的县级人民政府计划生育行政部门批准后，领取《再生一胎生育证》;其中夫妻双方是农民的，可由女方户籍所在地的乡(镇)人民政府审核批准并发证。 对在现居住地生活1年以上的因婚姻关系形成事实迁移的人员，经户籍所在地出具生育情况证明，可以按照现居住地的生育规定执行。 第九条符合下列情形之一的夫妻，在领取《再生一胎生育证》后，可以怀孕并再生育一胎子女: (一)双方均为独生子女，只生育1个子女的。 (二)独生子女死亡的。 (三)只有1个子女，该子女经设区的市人民政府计划生育行政部门设立的技术鉴定组织确诊患有非遗传性残疾，不能成长为正常劳动力的。 (四)一方为革命烈士亲生独生子女或者二等乙级以上伤残军人，只生育1个子女的。 (五)一方在煤矿井下连续从事采矿作业5年以上，并仍在从事煤矿井下采矿作业，只生育1个女孩的。 (六)双方均为少数民族，且居住在县级以上人民政府确定的少数民族聚居地，只生育1个子女的。 (七)归侨、侨眷或者在本省定居的香港特别行政区、澳门特别行政区居民、台湾同胞，其子女均在国外或者香港特别行政区、澳门特别行政区、台湾定居的。 (八)双方均系华侨，一方回国时间在6年以内，只生育1个子女的。 (九)再婚夫妻一方再婚前只生育1个子女，另一方未生育的。 (十)双方均为农民并具有下列情形之一的: 1(只生育1个女孩的; 2(男方到无兄弟的女方家结婚落户只生育1个子女的，但女方姐妹有2人以上的，只能准许1人; 3(一方为独生子女，且其父亲或者母亲亦无兄弟姐妹，只生育1个子女的; 4(男方的兄弟均无子女并已丧失生育能力，只生育1个子女的。 (十一)省人民政府计划生育行政部门根据法律、法规和国家有关规定批准的其他特殊情况。 前款除第二项、第七项规定外，再生育一胎妇女的年龄不得低于25周岁;再生育一胎的间隔期不得少于4周年。生育妇女的年龄超过28周岁的，再生育一胎的间隔期可缩短至2周年。 双方原均为农民，后转为城镇户籍，属本人要求转的，自转为城镇户籍之日起1年内可按农民对待，依法办理《再生一胎生育证》;属政府统一安排转的，自转为城镇户籍之日起3年内可按农民对待，依法办理《再生一胎生育证》。 第十条符合本条例第八条规定申请一胎生育的，发证机关应当在收到申请表之日起5日内办理完毕。 符合本条例第九条规定申请再生育一胎的，除第九条第一款第三项规定外，发证机关应当在收到申请表之日起20日内办理完毕。 符合本条例第九条规定可再生育一胎的夫妻，由于发证机关的延误未取得《再生一胎生育证》，但已经怀孕的，发证机关应当在其分娩前为其补发《再生一胎生育证》。 办理《一胎生育证》和《再生一胎生育证》只收取工本费，发证机关不得以各种名义收取with effective measures. Intelligent retrieval system to support video content enhancements, can be used for video content by keyword, key features of the automatic search, image and video search feature and video display. 其他费用。工本费的收取标准由省价格主管部门会同省财政部门核定。 第十一条夫妻一方经县级以上人民政府卫生行政部门指定的医疗、保健机构检查，确诊患有医学上认为不宜生育疾病的，必须落实避孕节育措施;已怀孕的，必须立即终止妊娠。 生育过经医学鉴定属非遗传性残疾婴儿的，再次妊娠前，夫妻双方应当按照国家有关规定到医疗、保健机构接受优生指导和优生检测。 第十二条禁止任何单位和个人擅自采取技术手段对胎儿进行性别鉴定。 对怀疑胎儿可能为伴性遗传病等其他疾病，医学上确有需要进行性别鉴定的，应当由县级以上人民政府卫生行政部门指定的医疗、保健机构出具证明，并经县级以上人民政府计划生育行政部门批准，到省人民政府卫生行政部门指定的医疗、保健机构进行性别鉴定。 医疗、保健机构和计划生育技术服务机构应当建立对孕妇的B型超声检查和其他能够鉴定胎儿性别的技术检查的登记制度，登记检查原因及检查结果等事项，并由2名以上医务人员或者计划生育技术服务人员在登记表上签名。 医疗、保健机构和计划生育技术服务机构有义务向计划生育行政部门提供前款规定的有关登记资料。 第十三条禁止非医学需要的性别选择性引产。符合本条例规定的生育条件的夫妻怀孕后，进行非医学原因性别选择性引产的，不再为其安排生育指标，再生育的视为计划外生育。 第十四条实行计划生育，以避孕为主。已生育子女的育龄夫妻应当采取有效的避孕措施，提倡选择长效避孕措施。 各级人民政府应当创造条件，保障公民知情选择安全、有效、适宜的避孕节育措施。施行避孕节育手术，应当保证受术者的安全。 计划外怀孕的，应当在计划生育技术服务人员指导下落实补救措施。 第三章技术服务 第十五条计划生育行政部门综合管理计划生育技术服务工作，并配合卫生行政部门做好优生管理工作。 计划生育行政部门和卫生行政部门在各自的职责范围内做好所管辖机构的计划生育技术服务的管理、指导工作。 计划生育技术服务机构和从事计划生育技术服务的医疗、保健机构应当在各自的职责范围内，对公民开展人口与计划生育科普知识宣传教育，对已婚育龄妇女进行孕情检查、随访服务，提供计划生育、生殖保健的咨询、检查和技术服务。 第十六条从事计划生育有关临床技术服务的人员，应当依照《中华人民共和国执业医师法》和国家有关护士管理的规定，分别取得执业医师、执业助理医师、乡村医生或者护士的资格并在批准的机构中执业，遵守与执业有关的法律、法规、规章、技术常规、职业道德和，保证受术者的安全。 禁止个体行医人员和未取得合法资格的人员施行计划生育手术。 第十七条施行绝育手术后，子女死亡，符合本条例第九条规定的条件可以再生育一胎的夫妻，经县级人民政府计划生育行政部门批准，可以在指定的医疗、保健机构或者计划生育技术服务机构进行输卵(精)管复通手术。 第十八条各级财政应当保证国家规定免费的计划生育技术服务项目所需费用，但已实行生育保险或者基本医疗保险的国家工作人员、事业单位和各类企业职工除外。 免费提供的技术服务范围包括:一般避孕药具、环孕检、放置和取出宫内节育器、绝育术、人工终止妊娠术。 国家工作人员、事业单位和各类企业职工的计划生育手术费，已实行生育保险的，从生育with effective measures. Intelligent retrieval system to support video content enhancements, can be used for video content by keyword, key features of the automatic search, image and video search feature and video display. 保险基金中支付;未实行生育保险但已实行基本医疗保险的，从基本医疗保险统筹基金中支付;既未实行生育保险又未实行基本医疗保险的，由其所在单位支付。 农民、城镇无业居民、个体工商户的计划生育手术费由其所在的县级人民政府计划生育行政部门结算，从计划生育事业费中支付。 第十九条经依法鉴定属计划生育手术引起并发症的，由县级以上人民政府计划生育行政部门指定的计划生育技术服务机构或者医疗、保健机构进行治疗，治疗费按节育手术费支付办法处理。 第四章管理责任 第二十条建立与完善依法管理、村(居)民自治、优质服务、政策推动、综合治理的计划生育工作机制。 县级以上人民政府应当根据上级人民政府制定的人口发展规划和本行政区域的实际，制定本行政区域的人口发展规划，将其纳入国民经济和社会发展计划，同时根据人口发展规划制定人口与计划生育实施并组织实施。 各级人民政府应当加强对计划生育工作的领导，实行人口与计划生育目标管理责任制。凡超过年度计划生育控制指标的设区的市、县(市、区)、乡(镇)，3年内不得评为综合性先进，其主要负责人不能晋升职务。 第二十一条县级以上人民政府计划生育行政部门负责本行政区域内的计划生育工作和与计划生育有关的人口工作，其主要职责是: (一)结合本地实际，贯彻执行人口与计划生育法律、法规、规章和方针、政策; (二)在当地人民政府领导下，负责实施人口与计划生育实施方案的日常工作，开展经常性的宣传教育、综合服务、科学管理工作; (三)加强基层基础工作和管理服务网络建设，依法建立计划生育行政管理、技术服务、群众工作队伍。 第二十二条县级以上人民政府应当建立人口与计划生育工作协调制度。 县级以上人民政府其他有关部门应当各司其职，互相配合，负责有关的人口与计划生育工作，其主要职责是: (一)根据本级政府确定的职责分工，结合本部门业务特点，与计划生育行政部门共同做好人口与计划生育工作; (二)结合本部门职能，研究、制定有利于人口与计划生育工作的相关社会经济政策及措施; (三)根据本部门计划生育职责制定相应的措施与办法，并负责组织实施和对下级督促指导。 第二十三条乡(镇)人民政府、街道办事处负责管理本辖区的计划生育工作，设立计划生育工作机构并配备专职计划生育工作人员。 第二十四条村(居)民委员会应当依法做好计划生育工作，将计划生育工作纳入村(居)民自治内容;村(居)民委员会应当有专人负责计划生育工作，并合理解决其报酬。 村(居)民委员会实行计划生育公开、透明制度。在为申请领取《再生一胎生育证》的已婚育龄夫妻出具证明前，应当进行公示。 村(居)民委员会依法开展下列计划生育工作: (一)向辖区内村(居)民宣传人口与计划生育的法律、法规、规章和方针、政策，普及人口与计划生育科学知识; (二)及时向人民政府计划生育行政部门或者工作机构通报辖区内人口与计划生育工作的with effective measures. Intelligent retrieval system to support video content enhancements, can be used for video content by keyword, key features of the automatic search, image and video search feature and video display. 情况; (三)维护实行计划生育公民的合法权益，落实法律、法规规定的奖励与优待的规定; (四)组织村(居)民参与制定和实施人口与计划生育工作方案; (五)对人民政府及其计划生育行政部门开展计划生育工作实施监督。 在基层可以实行计划生育管理制度。村(居)民委员会可以与已婚育龄夫妻签订计划生育协议。 第二十五条实行已婚育龄妇女环检、孕检制度，由乡(镇)人民政府、街道办事处负责组织实施。 县级以上人民政府卫生行政部门应当建立婴儿出生与死亡通报制度，在每季度末将婴儿出生与死亡资料反馈给当地计划生育行政部门。 建立新生儿户籍登记通报制度。基层公安派出所应当在每季度末将新生儿户籍登记资料反馈给当地计划生育行政部门。 第二十六条建立属地管理、单位负责、居民自治、社区服务的城市人口与计划生育管理机制。 城市区人民政府、街道办事处、居民委员会统一管理驻本辖区各机关、社会团体、企业事业组织以及工作、生活在本辖区的常住人口、暂住人口的计划生育工作，承担宣传动员、监督检查、组织协调、综合服务的职能。 城市人口与计划生育工作应当依托社区、面向家庭，广泛开展计划生育综合服务。 第二十七条本省行政区域内的机关、社会团体、企业事业组织负有做好本单位计划生育工作的责任，保证奖惩与优待等措施的落实。 实行法定代表人或者主要负责人计划生育工作责任制。单位法定代表人或者主要负责人应当与所在地的县级人民政府计划生育行政部门签订计划生育工作责任书。 第二十八条计划生育、教育、科技、文化、卫生、民政、新闻出版、广播电视等行政部门应当组织开展人口与计划生育宣传教育工作。 大众传媒应当开展人口与计划生育的社会公益性宣传。 第二十九条计划生育统计工作必须严格执行统计法律、法规的规定，任何单位和个人不得虚报、瞒报、伪造、篡改、拒报计划生育统计资料。 第三十条建立人口与计划生育工作监督和责任追究机制。上级人民政府对下级人民政府，人民政府对相关部门、社会团体、企业事业单位、村(居)民委员会的人口与计划生育工作职责履行情况进行监督，并对工作失职者进行追究。 第三十一条计划生育行政部门在查处计划外生育的过程中，可以进行调查，组织鉴定，有关单位和个人应当予以配合。 第五章流动人口的计划生育 第三十二条流动人口计划生育工作实行综合管理。 计划生育行政部门及其他有关部门应当在本级人民政府的统一领导下，在各自的职责范围内做好流动人口计划生育管理和服务工作。 第三十三条流动人口的计划生育工作由其户籍所在地和现居住地的人民政府共同管理，以现居住地管理为主。 流动人口现居住地的县级人民政府计划生育行政部门和乡(镇)人民政府或者街道办事处负责对流动人口计划生育工作的日常管理，并将流动人口计划生育工作纳入当地计划生育管理。 第三十四条成年流动人口在离开户籍所在地前，应当凭合法的婚姻、身份证件，到当地县with effective measures. Intelligent retrieval system to support video content enhancements, can be used for video content by keyword, key features of the automatic search, image and video search feature and video display. 第四十九条独生子女发生意外伤残、死亡，其父母不再生育或者收养子女的，县级人民政府应当给予必要的帮助。 第五十条在计划生育工作中取得显著成绩的单位和个人，其主管部门或者当地人民政府应当给予表彰、奖励。 对据实举报计划外怀孕、生育或者在计划生育工作中弄虚作假、徇私舞弊等行为的人员，应当给予保护和奖励。 第五十一条县级以上人民政府可以设立人口与计划生育奖励专项经费，用于对实行计划生育公民的奖励和社会保障。经费来源于各级人民政府的财政投入、征收的社会抚养费以及社会团体、企业事业组织和个人提供的捐助。 机关、社会团体、企业事业组织应当落实本条例规定的计划生育奖励与社会保障措施的经费。 第七章法律责任 第五十二条违反本条例规定，有下列情形之一的，为计划外生育: (一)不符合本条例第九条第一款规定的条件再生育的; (二)符合本条例第九条第一款规定的条件，但未申请领取《再生一胎生育证》生育的; (三)未达到本条例第九条第二款规定的间隔年限生育的; (四)未到法定婚龄怀孕生育或者非婚生育、重婚生育的。 为他人计划外生育提供帮助而非法收养子女的，视为计划外生育。 计划外生育的，应当对其征收社会抚养费。 第五十三条不符合本条例第九条第一款规定的条件再生育或者重婚生育的，除按规定征收社会抚养费外，还应当按下列规定处理: (一)属国家工作人员、事业单位和各类企业职工的，给予撤职、开除的处分或者解除劳动关系，其中女职工产假期间停发工资、奖金，不享受有关生育的福利待遇，孕期检查、分娩、产褥期的医药费均自理; (二)属农民的，5年内不得享受集体福利。 第五十四条对出现计划外生育的单位，由上级主管部门或者行政监察机关视情节轻重对其法定代表人或者主要负责人给予处分。 第五十五条有下列情形之一的，由县级以上人民政府计划生育行政部门或者卫生行政部门依据职权责令改正，给予警告，没收违法所得;违法所得1万元以上的，处违法所得2倍以上6倍以下罚款;没有违法所得或者违法所得不足1万元的，处1万元以上3万元以下罚款;情节严重的，由原发证机关吊销执业证书: (一)非法为他人摘取避孕节育环，或者采取其他方式妨碍避孕节育的; (二)非法施行输卵(精)管复通手术的; (三)个体行医人员及其他未取得合法资格的人员施行计划生育手术的; (四)为他人进行非医学需要的胎儿性别鉴定或者选择性别的人工终止妊娠的; (五)实施假节育手术、进行假医学鉴定、出具假计划生育证明的。 对出现前款规定情形之一的单位直接负责的主管人员和其他直接责任人员，依法给予处分。 第五十六条伪造、变造、买卖计划生育证明，由县级以上人民政府计划生育行政部门没收违法所得，违法所得5000元以上的，处违法所得2倍以上10倍以下罚款;没有违法所得或者违法所得不足5000元的，处5000元以上2万元以下罚款。 以不正当手段取得计划生育证明的，由县级以上人民政府计划生育行政部门取消其计划生with effective measures.
