恶意透支论文：恶意透支型信用卡诈骗罪若干问题研究 恶意透支论文:恶意透支型信用卡诈骗罪若干问题研究 【中文摘要】伴随我国经济的不断发展,信用卡的使用得到了飞速发展,信用卡的透支功能在方便人们消费的同时,也给许多不法分子以可乘之机。各种类型的信用卡犯罪应运而生,特别是恶意透支型信用卡诈骗犯罪愈演愈烈,犯罪分子利用信用卡本身具有的透支功能大肆恶意透支,骗取银行资金,对我国稳定健康的金融秩序造成了冲击。随着形势的发展,犯罪分子的作案手法也不断变化与翻新,使预防与打击恶意透支型信用卡诈骗犯罪的难度不断加大,司法实践中也有若干问题需要厘清。因此如何准确定性恶意透支行为,有效打击恶意透支型信用卡诈骗犯罪,保障我国信用卡业务健康发展、银行资金安全、金融秩序稳定业已成为当务之急。为此,笔者特以恶意透支型信用卡诈骗罪若干问题研究为题,针对恶意透支型信用卡诈骗罪的主体、主观方面、客观方面、数额等四方面开展研究,并就司法实践中存在的若干疑难问题进行分析解答,希望能对预防和打击此类犯罪提供些许帮助。本文除导言外共分为四章。第一章“恶意透支型信用卡诈骗犯罪的主体问题研究”从该类型犯罪的主体身份入手,针对理论和实践对恶意透支型信用卡诈骗罪主体的不同理解,着重围绕恶意透支“持卡人”的范围只能是合法持卡人、恶意透支犯罪的共犯形式与罪名、增设单位主体的必要性等相关问题展开论述。第二章“恶意透支型信用卡诈骗犯罪的主观方面问题研究”主要研究犯罪主体对其实施恶意透支的危害行为及其危害结果所持的心理态度。通过分析透支 行为多重法律性质的演变把握持卡人的主观意志,得出“具有非法占 有的”是区分恶意透支刑民界限的结论。随后对运用“客观推定与主 观认定相结合”的方式认定“非法占有的”进行探讨,对司法实践中 认定主观方面所产生的疑难问题进行研析。第三章“恶意透支型信用 卡诈骗罪的客观方面问题研究”着重对刑法中恶意透支型信用卡诈骗 罪两个客观方面的要求:“超过规定限额或者规定期限透支”与“经 发卡银行两次催收后超过3个月仍不归还的”的认定进行解读,针对 规定期限与催收的时间、次数与方式进行深入探讨,为解决实践问题 提供破解思路。第四章“恶意透支型信用卡诈骗罪数额问题研究”以 数额认定的范围与标准为切入点开展论述,从立法本意、透支行为的 民刑转化等角度阐述了恶意透支的数额应当适当包括利息的观点。同 时对司法实践中常见的“小额还款”、“提前还款”、“共犯还款”等还 款后恶意透支的司法认定进行了剖析。 【英文摘要】Accompany with continuously development of our country economy, the usage of credit card is prevalent soon, the overdraft function of credit card promote people to consume, also give many criminals to get use of it. The credit card crime of various type emerges, especially malicious overdraft happens more and more, the criminal makes use of the overdraft function that the credit card owns and cheats funds of bank, impact the financial order of stable health of our country. Along with the development of situation, crime skills of criminals continuously change and turn over lately, it’s more hard to prevent and strike malicious overdraft, there are also many problem in the judicatory practices need to be solved. Consequently how to determine malicious overdraft behavior accurately, strike malicious overdraft effectively, guarantee healthy development of our country credit card business, bank funds safety, steady financial order has become urgent matter of the moment. For this, writer especially researches on problems of malicious overdraft, aims at the corpus, subjective aspect and objective aspect, and amount of malicious overdraft and some existent difficulty problems in the judicatory practices, wants to provide some help to prevent and strike the crime .In addition to introduction, this text is totally divided into four chapters.Chapter 1” research on the corpus of malicious overdraft “ commences from the corpus identity of the crime and aim at on different comprehension of the crime on theories and practices, insist that the scope of “card holder” can only be the legal card holder, complicity of malicious overdraft and the necessity of establishing unit corpus related problem to launch treatise.Chapter 2” research on the subjective aspect of malicious overdraft “ mainly researches on the mention to the compromise and crime of the crime corpus.By analysing evolvement of multiple law properties confidence, recognizing the card holder’s subjective will , resulting in the conclusion that “having the purpose of illegal occupancy” is the boundary between malicious overdraft and well-meaning overdraft. Later on,this section carries on a study on the way of “combination of objective prediction and subjective affirmation”to recognize” the purpose of illegal occupancy “, to affirm difficulty problems in the judicial practices on this aspect.Chapter 3” research on the objective aspect of malicious overdraft” emphasizes the two types of objective aspect of the malicious overdraft:”Exceeding amount limit or time limit to overdraw” and “the card’s holder fails to return the money after the bank issuing the card urges him to pay it twice before three months”, aim at time limit and time and degree and way of urge, for solving a crack fulfillment to the judicial practices.Chapter 4” research on the amount of malicious overdraft “ analyzes the scope and standard of amount limit, affirms that the overdraft interest shall be counted in in a way by legislation and the conversion between civil and criminal.
