论交通肇事罪 摘 要 交通肇事罪是指违反交通运输管理法规，因而发生重大事故，致人重伤、死亡或者使公私财产遭受到重大损失的行为。随着交通运输事业的日益发达，车辆数量的急剧增长，交通肇事罪已成为1种常见高发的犯罪类型，给国家和人民生命财产造成了重大损失，成为社会安定、和谐的1大隐患。时下，不少学者对交通肇事罪的主体、对交通肇事逃逸应该如何处理、信赖原则在交通肇事领域的适用等问作了较为深刻的研究。但是，在其讨论过程中仍然存在某些观念的差异和分歧，因此，对这些问题进行更深1步的研究与探讨，以期对司法实践有所帮助。 关键词： 交通肇事   逃逸   信赖原则   完善 Abstract The crime of causing traffic casualties is which referring to violate the traffic management laws and regulations, thus has the significant accident, sends the person severe wound, the death or causes the public and private property to suffer the heavy loss. With the transportation enterprise day by day developing, and the vehicles quantity growing suddenly, the crime of causing traffic casualties is becoming one kind of common and frequent crime, has caused great damage to nation and people’s life and property society. Presently, many scholars do some deeply research about this crime, such as the body of this crime, and how to deal with the escaping, and application of the faith principle in the field of causing traffic trouble. But there still had certain different ideas about this crime in the course of discussion. Therefore, in order to have some help to the judicial practice by the time, deeper research and discussion to these questions is necessary.
