《山东省人口与计划生育条例》2013年6月2日修正 山东省人口与计划生育条例 (2002年9月28日山东省第九届人民代表大会常务委员会第三十一次会议通过 根据2013年6月2日山东省第十二届人民代表大会常务委员会第二次会议《关于修改〈山东省人口与计划生育条例〉的决定》修正) 第一章 总 则 第一条 为了控制人口数量，提高人口素质，实现人口与经济、社会、资源、环境协调发展，维护公民的合法权益，促进家庭幸福、民族繁荣和社会进步，根据《中华人民共和国人口与计划生育法》等法律、法规，结合本省实际，制定本条例。 第二条 本条例适用于居住在本省行政区域内的中国公民和户籍在本省而居住在省外的公民，以及本省行政区域内的一切机关、社会团体、企业事业组织、群众自治组织和其他组织。 第三条 实行计划生育是国家的基本国策。 公民有生育的权利，也有依法实行计划生育的义务，夫妻双方在实行计划生育中负有共同的责任。 第四条 各级人民政府及其工作人员在推行计划生育工作中应当坚持依法行政、文明执法、热情服务，不得侵犯公民的合法权益。 计划生育行政部门及其工作人员依法执行计划生育公务受法律保护。 第五条 各级人民政府领导本行政区域内的人口与计划生育工作。 县级以上计划生育行政部门负责本行政区域内的计划生育工作和与计划生育有关的人口工作。 县级以上人民政府其他有关部门在各自的职责范围内，负责有关的人口与计划生育工作。 第六条 全社会都应当积极支持人口与计划生育工作。工会、共产主义青年团、妇女联合会、计划生育协会等社会团体、企业事业组织和公民应当协助人民政府开展人口与计划生育工作。 第七条 各级人民政府应当实行人口与计划生育目标管理责任制，将人口与计划生育工作作为考核政府政绩和单位负责人实绩的重要依据。 第八条 各级人民政府应当对在人口与计划生育工作中做出显著成绩的组织和个人给予表彰、奖励。 第二章 人口发展规划的制定与实施 should be conducted in the presence of the supervisor. (2) the standard markers together with the accessories insert the bottom has not been final set in advance concrete, exposed bottom concrete 第九条 县级以上人民政府根据国家和上一级人民政府人口发展规划，编制本行政区域的人口发展规划，将其纳入国民经济和社会发展计划，根据人口发展规划制定人口与计划生育实施并组织实施。 县级以上计划生育行政部门负责实施人口与计划生育实施方案的日常工作。 第十条 乡(镇)人民政府、街道办事处负责本管辖区域内的人口与计划生育工作，贯彻落实人口与计划生育实施方案。 第十一条 村(居)民委员会应当配备专(兼)职计划生育工作人员。 村(居)民会议可以依法制定计划生育村规民约或者居民公约。 村(居)民委员会与育龄公民可以依法签订计划生育，约定双方的权利与义务。 第十二条 机关、社会团体、企业事业组织实行法定代表人或者负责人计划生育责任制，具体负责本单位计划生育管理和服务工作。 第十三条 人口与计划生育管理工作应当公开，自觉接受公众监督。 第十四条 城市人口与计划生育工作实行属地管理。 流动人口计划生育工作由流动人口户籍所在地和现居住地的人民政府共同负责，以现居住地人民政府为主，户籍所在地人民政府予以配合。 第十五条 计划生育、教育、科技、文化、卫生、民政、司法行政、新闻出版、广播电视等有关部门应当组织开展人口与计划生育宣传教育。 第十六条 人口与计划生育的统计应当及时、准确，有关单位和个人不得虚报、瞒报、伪造、篡改或者拒报人口与计划生育统计数据。 发展计划、计划生育、公安、劳动保障、民政、教育、人事、卫生、统计等有关部门对有关人口信息资源实行共享。 第十七条 各级人民政府应当根据国民经济和社会发展状况逐步提高人口与计划生育经费投入的总体水平，保障人口与计划生育工作必要的经费。 各级人民政府应当对贫困地区人口与计划生育工作给予重点扶持。 政府鼓励社会团体、企业事业组织和个人为人口与计划生育事业提供捐助。 任何单位和个人不得截留、克扣、挪用人口与计划生育费用。 第十八条 政府鼓励开展人口与计划生育领域的科学研究和对外交流与合作。 第三章 生育调节 第十九条 鼓励公民晚婚晚育、少生优生，提倡一对夫妻生育一个子女，符合本条例规定条件的公民，经批准可以生育第二个子女。 should be conducted in the presence of the supervisor. (2) the standard markers together with the accessories insert the bottom has not been final set in advance concrete, exposed bottom concrete 男年满二十五周岁、女年满二十三周岁初婚的为晚婚，已婚妇女年满二十三周岁妊娠生育第一个子女的为晚育。 第二十条 生育第一个子女实行免费登记。 夫妻可以自行选择生育第一个子女的时间，在生育前应当到一方户籍所在地或者现居住地的乡(镇)人民政府或者街道办事处进行生育登记，免费领取《计划生育服务手册》，凭手册享受计划生育优先优惠服务。《计划生育服务手册》的办理实行首接负责制。 《计划生育服务手册》样本由省计划生育行政部门统一制定。 第二十一条 具有下列特殊情形之一，经夫妻双方申请、县级计划生育行政部门批准，可以生育第二个子女: (一)夫妻双方均为独生子女的; (二)经设区的市以上计划生育技术鉴定组确诊第一个子女为非遗传性残疾，不能成长为正常劳动力的; (三)曾患不育症，依法收养一个子女后又怀孕的; (四)夫妻双方均为少数民族的; (五)夫妻一方从事矿工井下作业连续五年以上，现仍从事该项工作，只生育一个女孩的; (六)夫妻一方从事外海、远洋捕捞作业连续五年以上，现仍从事该项工作，只生育一个女孩的; (七)夫妻一方为烈士的独生子女或者六级以上残疾军人的; (八)夫妻一方因非遗传性残疾失去劳动能力，只生育一个女孩的; (九)再婚夫妻一方只生育一个子女，另一方未生育的。 第二十二条 夫妻双方均为农村居民且以农林牧渔业收入为主要生活来源，具有下列特殊情形之一，经夫妻双方申请、县级计划生育行政部门批准，可以生育第二个子女: (一)男方到有女无儿家结婚落户，与女方父母共同生活并履行赡养义务的(女家姐妹数人，只照顾一人); (二)兄弟两人以上，只有一个有生育条件，且只生育一个子女，其他兄弟均已丧失生育条件并未收养子女的; (三)在与内陆不连接的海岛定居的。 第二十三条 只生育一个女孩，母女均为农村居民且母亲居住在农村连续五年以上，以农林牧渔业收入为主要生活来源的，经夫妻双方申请、县级计划生育行政部门批准，可以生育第二个子女。 should be conducted in the presence of the supervisor. (2) the standard markers together with the accessories insert the bottom has not been final set in advance concrete, exposed bottom concrete 第二十四条 夫妻双方再婚前各有一个子女，均随前婚配偶，新组合家庭无子女的，经夫妻双方申请、县级计划生育行政部门批准，可以生育第二个子女。 第二十五条 申请生育第二个子女的夫妻，应当在妊娠前到女方户籍所在地的乡(镇)人民政府或者街道办事处办理生育证。申请办理生育证时应当提交生育申请书，并提交下列证件和证明: (一)双方的居民身份证、结婚证; (二)双方所在单位或者村(居)民委员会出具的本人生育证明; (三)已收养子女的，民政部门出具的收养证明; (四)具有本条例规定的特殊情形之一的证明。 乡(镇)人民政府或者街道办事处应当对公民的生育申请及时受理、审核，并自受理申请之日起二十日内将审核意见和申请人的申请材料报县级计划生育行政部门审批。县级计划生育行政部门应当自收到申请材料之日起十日内对符合生育条件的发给生育证;对不符合生育条件的以书面形式告知不批准生育的理由。 第二十六条本省居民涉外生育，涉及香港、澳门、台湾同胞的生育以及归国华侨和出国留学人员的生育，按照国家有关规定办理。 第二十七条病残儿医学鉴定申请，由县级计划生育行政部门受理初审后报设区的市计划生育行政部门组织医学鉴定。申请人对鉴定结论有异议的，可以向省计划生育行政部门申请重新鉴定。省计划生育行政部门组织的鉴定结论为终局鉴定。 第二十八条禁止歧视、虐待生育女婴的妇女和不育的妇女。禁止歧视、虐待、遗弃婴儿。 溺婴、遗弃婴儿和违法送养子女的，不再批准其生育申请。 第四章 奖励与社会保障 第二十九条男女双方晚婚的，除国家规定的婚假外，增加婚假十四日。女方晚育的，除国家规定的产假外，增加产假六十日，并给予男方护理假七日。增加的婚假、产假、护理假，视为出勤，工资照发，福利待遇不变。 农民、城镇失业人员实行晚婚晚育的，由乡(镇)人民政府、街道办事处或者村(居)民委员会给予适当奖励，并提供优先优惠的计划生育技术服务。 第三十条只有一个子女自愿不再生育的，经本人申请所在单位或者村(居)民委员会核实，由乡(镇)人民政府或者街道办事处发给《独生子女父母光荣证》，凭证享受以下奖励: should be conducted in the presence of the supervisor. (2) the standard markers together with the accessories insert the bottom has not been final set in advance concrete, exposed bottom concrete (一)从申请当月起至子女年满十四周岁止，每月领取不少于十元的奖励费。奖励费由夫妻双方所在单位各发百分之五十。机关、事业组织工作人员的奖励费由所在单位从行政事业费中列支;企业职工的奖励费由所在单位从企业公益金中列支;城镇失业人员和农民的奖励费由所在街道办事处或者乡(镇)人民政府负责兑现，确有困难的，由县(市、区)财政予以适当补助。 (二)独生子女父母为机关、事业组织职工的，退休后加发本人工资百分之五的退休金(退休金为百分之百的不加发)，其经费从原渠道列支。独生子女父母为企业职工的，退休时由所在单位按照设区的市上一年度职工年平均工资的百分之三十发给一次性养老补助。 (三)各级人民政府对实行计划生育的夫妻、农村独生子女家庭和生育两个女孩已实施绝育手术的家庭在发展经济中，应当给予信息、资金、技术、等方面的支持和优惠;对实行计划生育的贫困家庭，在扶贫贷款、以工代赈、扶贫项目、社会救济、划分宅基地等方面给予优先照顾。 提倡对农村自愿终生只要一个女孩的夫妻给予重奖。 第三十一条 对年满六十周岁，符合计划生育家庭奖励扶助条件的夫妻，按照国家和省有关规定给予奖励扶助。 对独生子女残疾、死亡后未再生育并且未收养子女的夫妻以及其他符合特别扶助条件的夫妻，按照国家和省有关规定给予特别扶助。 第三十二条 对独生子女死亡后未再生育并且未收养子女的夫妻，原独生子女父母奖励待遇不变;享受最低生活保障的，给予高出最低生活保障线三分之一的照顾。 生育双胞胎或者多胞胎的，不享受独生子女父母奖励待遇。 第三十三条 对领取《独生子女父母光荣证》后又生育的，由发证机关收回光荣证，停止凭证享受的各种优待，并追回领取的各种奖励。 第三十四条 各级人民政府应当大力发展基本养老保险、基本医疗保险和生育保险及其他社会福利事业，促进计划生育。 鼓励有条件的地方根据政府引导、农民自愿的原则，实行多种形式的养老保障办法。 各级人民政府应当制定相应政策，鼓励组织和个人多方筹集资金，兴办不同形式的老年福利机构，逐步形成以社区为主体的老龄人口服务网络。 第三十五条 县级以上人民政府可以设立计划生育公益金。计划生育公益金由政府拨款、民间捐资、社会募捐、国际捐赠等资金组成，主要用于有关计划生育特殊情况的扶持和救助。 should be conducted in the presence of the supervisor. (2) the standard markers together with the accessories insert the bottom has not been final set in advance concrete, exposed bottom concrete 第五章 计划生育技术服务 第三十六条 公民享有避孕方法的知情选择权。育龄夫妻应当及时落实避孕节育措施，接受计划生育技术服务指导，预防和减少非意愿妊娠。 各级人民政府应当保障公民获得适宜的计划生育技术服务的权利。提倡已生育过子女的夫妻，选择长效避孕节育措施。 第三十七条 各级计划生育技术服务机构承担计划生育技术服务、宣传咨询、业务培训、药具供应等职责。 第三十八条 各级计划生育技术服务机构和从事计划生育技术服务的医疗保健机构应当在各自的职责范围内普及避孕节育、孕期检查、随访服务、优生优育、生殖保健科学知识，促进孕前管理，保证受术者安全，防止或者减少出生缺陷。 第三十九条 各级人民政府应当保障实行计划生育的育龄夫妻免费享受国家规定的基本项目的计划生育技术服务。计划生育技术服务免费项目、服务费用及计划生育手术并发症的鉴定和处理按照国家有关规定执行。 第四十条 医疗保健机构和计划生育技术服务机构及其工作人员在提供孕产期保健和接生服务时，应当查验孕产妇的《计划生育服务手册》或者生育证;发现无《计划生育服务手册》或者生育证的，应当在三日内告知该机构所在地县级计划生育行政部门。 第四十一条 严禁利用超声技术和其他技术手段进行非医学需要的胎儿性别鉴定;严禁非医学需要的选择性别的人工终止妊娠。 第六章 法律责任 第四十二条 对不符合本条例规定生育子女的公民，由县级计划生育行政部门以所在地的县级人民政府上一年度统计公报公布的城镇居民年人均可支配收入或者农村居民年人均纯收入为基数，结合当事人的实际收入水平和不符合法律、法规规定生育子女的情节，按照男女双方各自的子女数分别计征社会抚养费。 第四十三条 对具有本条例第二十一条、第二十二条、第二十三条和第二十四条规定的情形之一，妊娠前未申请办理生育证的，由乡(镇)人民政府或者街道办事处责令其妊娠后补办生育证;生育时仍未申请补办生育证的，按照第四十二条规定的基数的二分之一征收社会抚养费。 对不具有本条例第二十一条、第二十二条、第二十三条和第二十四条规定的情形之一而生育第二个子女的，按照第四十二条规定的基数的三至四倍征收社会抚养费。 should be conducted in the presence of the supervisor. (2) the standard markers together with the accessories insert the bottom has not been final set in advance concrete, exposed bottom concrete 第四十四条 对符合法定结婚条件但未办理结婚登记而生育第一个子女的，应当自生育之日起六十日内补办结婚登记;逾期未补办的，按照第四十二条规定的基数的二分之一征收社会抚养费。 对不符合法定结婚条件而生育第一个子女的，按照第四十二条规定的基数征收社会抚养费，并不再批准其生育第二个子女。 有配偶者与他人生育第一个子女的，按照第四十二条规定的基数的四倍征收社会抚养费;生育第二个子女的，按照第四十二条规定的基数的五倍征收社会抚养费。 有配偶而重婚或者明知他人有配偶而与之结婚生育第一个子女的，按照第四十二条规定的基数的五倍征收社会抚养费;生育第二个子女的，按照第四十二条规定的基数的六倍征收社会抚养费。 当事人有本条第三款、第四款规定的情形，其年实际收入高于第四十二条规定的基数的，以年实际收入为基数计征社会抚养费。 第四十五条 对不符合本条例规定生育第三个以上子女的，按照第四十二条规定的基数的六倍以上十倍以下征收社会抚养费。 有前款规定的情形，当事人年实际收入高于第四十二条规定的基数的，根据情节轻重，按照其年实际收入的六倍以上十倍以下征收社会抚养费。 第四十六条 对不符合法律、法规规定生育子女的流动人口征收社会抚养费，依照国家有关规定执行。 第四十七条 社会抚养费的征收，由县级计划生育行政部门作出书面征收决定;县级计划生育行政部门可以委托乡(镇)人民政府或者街道办事处作出书面征收决定。 第四十八条 县级计划生育行政部门决定对当事人征收社会抚养费，应当向男女双方当事人分别送达征收决定书。当事人收到征收决定书，应当在送达回证上记明收到日期并签名或者盖章。 征收决定书必须盖有征收机关印章，并载明下列事项: (一)当事人的姓名、性别、年龄和地址; (二)违法生育的事实和证据; (三)对男女双方当事人分别征收社会抚养费的法律依据和征收数额; (四)缴纳社会抚养费的方式、地点和期限; (五)不服征收决定申请行政复议、提起行政诉讼的途径和期限; (六)作出征收决定的县级计划生育行政部门名称和征收决定日期。 should be conducted in the presence of the supervisor. (2) the standard markers together with the accessories insert the bottom has not been final set in advance concrete, exposed bottom concrete 第四十九条 社会抚养费征收决定书自送达当事人之日起生效。当事人应当自收到征收决定书之日起三十日内一次性缴纳社会抚养费。 当事人实际收入水平过低，一次性缴纳社会抚养费确有实际困难的，应当自收到征收决定书之日起三十日内向作出征收决定的县级计划生育行政部门提出分期缴纳的书面申请，并提供有关证明材料。县级计划生育行政部门应当自收到当事人的申请之日起三十日内作出批准或者不批准分期缴纳的决定，并书面通知当事人。 第五十条 当事人应当到县级财政部门指定的金融机构缴纳社会抚养费。指定金融机构收到社会抚养费，应当向当事人出具由省财政部门统一印制的社会抚养费收据。 第五十一条 当事人未在规定的期限内缴纳社会抚养费的，自欠缴之日起每月加收欠缴社会抚养费的千分之二的滞纳金;仍不缴纳的，由作出征收决定的计划生育行政部门依法申请人民法院强制执行。 第五十二条 不符合本条例规定生育的，除依法征收社会抚养费外，属于国家工作人员的，由其所在单位或者有关组织依法给予行政处分;属于其他人员的，由其所在单位或者有关组织给予相应的纪律处分。 第五十三条 收养子女违反本条例规定的，追究相应的法律责任。 第五十四条 违反本条例规定，有下列行为之一的，由计划生育行政部门或者卫生行政部门依据职权责令改正，给予警告，没收违法所得;违法所得一万元以上的，处违法所得二倍以上六倍以下的罚款;没有违法所得或者违法所得不足一万元的，处一万元以上三万元以下的罚款;情节严重的，由原发证机关吊销执业证书;构成犯罪的，依法追究刑事责任: (一)非法为他人放置或者摘除宫内节育器，非法施行输精管、输卵管复通、终止妊娠等计划生育手术的; (二)未取得法定执业许可证的单位或者未取得法定执业资格的人员施行计划生育手术的; (三)利用超声技术或者其他技术手段为他人进行非医学需要的胎儿性别鉴定或者选择性别的人工终止妊娠的; (四)实施假节育手术、进行假医学鉴定的; (五)出具假生育证、假流动人口婚育证明、假独生子女父母光荣证等假计划生育证明的。 should be conducted in the presence of the supervisor.
