经济适用房申请 富阳市经济适用住房销售管理实施细则 为认真贯彻落实建设部等四部委《关于印发<经济适用住房>的通知》(建住房[2004]77号)精神，进一步规范我市经济适用住房销售行为，制定本实施细则。 一、销售、准入原则 购买经济适用住房实行准入、轮候、电脑公开摇号制度。在市区和中心镇同时建设经济适用住房的情况下，市区和中心镇的经济适用住房按区域划分范围向具有本区域户籍的家庭销售。在仅有市区一地建设经济适用住房的情况下，市区经济适用住房面向全市销售。 购买经济适用住房，必须同时具备下列条件: (一)具有本市常住城镇居民户口(含符合本市安置条件的军队人员); (二)已婚[不含离异(或丧偶)单身]或年龄在35周岁及以上的单身户; (三)已婚家庭户(2人及以上)无房或现有(或已有过)住房建筑面积小于48平方米(含48平方米);单身户无房; (四)属中低收入户(中低收入户，指按市统计局每年向社会公布的上年度居民人均可支配收入乘以户内人口数的三倍以下者)。 在上述同等条件下优先出售给军队转业干部、军队转业士官离休干部、杭州市级以上劳动模范中的无房户或住房困难户。 二、申请家庭工资总收入的核定 申请家庭上年度工资总收入状况，以单位或社区、街道核定盖章为准。 (一)申请家庭成员属行政、职工的，由所在单位或上级主管单位劳资部门核定，加盖单位公章。 (二)申请家庭成员属企业职工的，由所在单位劳资部门核定，加盖单位公章。 (三)申请家庭成员属灵活就业人员的，由户籍所在社区审核，所在街道确认，并加盖公章。居住地与户籍地不一致的，由居住地社区、街道确认后提供给户籍所在社区、街道核定。 三、现住房建筑面积的核定范围 advantages, facing the Yangtze River Delta, Pearl River Delta, Shandong peninsula, Beijing-Tianjin-Tangshan area, targeted investment promotion several times. Food research station platform, to the XX University to find experts 申请家庭已享受实物分房或通过市场方式购买(商品房或存量房)、赠与、继承等途径取得的所有住房，其建筑面积均纳入申请家庭住房面积核定范围。 下列住房纳入申请人家庭现有(或已有过)住房面积核定范围: (一)承租的公有住房; (二)已购买的房改房; (三)按政府优惠政策购买的解困房、安居房、集资合作建房、拆迁安置住房(如属货币安置未购买住房，以拆迁安置协议注明的安置面积为准)等; (四)申请建造的批地建房; (五)自有私房(含联建房)和通过继承、赠与等方式取得的各类私有住房; (六)通过市场方式购买的商品房、二手房、存量住房; (七)已交易出售的所有住房。 四、享受供应及面积确认 (一)享受供应标准 职工、居民购买经济适用住房建筑面积享受供应标准为:一般职工、居民7O平方米;科级干部或具有中级职称的知识分子80平方米;县处级干部或具有副高级职称的知识分子90平方米;厅局级干部或具有正高级职称的知识分子120平方米。高层、小高层住宅可增加建筑面积10平方米。 (二)现有住房面积确认方法 1、按同一户籍内的家庭人口数申请购买经济适用住房的，其户内人口所拥有住房的建筑面积，均核定为该户家庭已有住房建筑面积。 如两户以上的直系亲属，各自符合单独申请条件，合并为一户家庭申购的，按其家庭内人口所拥有住房的建筑面积核定为申请家庭已有住房建筑面积。 2、申请家庭成员属外地城镇户口的，其在户口所在地已享受实物分房或拥有其他住房的，其所有住房的建筑面积应一并核定为申请家庭已有住房的建筑面积。符合本细则申请条件的，持富阳市区常住城镇居民户口的一方可申请购买经济适用住房。 五、购买时的价格结算方法和计算公式 经济适用住房销售价格实行政府定价，按保本微利的原则确定 advantages, facing the Yangtze River Delta, Pearl River Delta, Shandong peninsula, Beijing-Tianjin-Tangshan area, targeted investment promotion several times. Food research station platform, to the XX University to find experts (一)价格结算方法 购买面积在核准面积以内部分，按政府确定的经济适用住房销售价格购买;超过核准面积的部分，不得享受政府优惠，应与市场价接轨，参照签订经济适用住房销售合同时周边普通商品房的价格(以下简称经济适用住房商品价)购买，具体价格由物价行政主管部门核准。 (二)价格计算公式 购房款=(可享受的经济适用住房建筑面积标准—已有住房建筑面积)×经济适用住房价格+[实际购买的经济适用住房建筑面积一(可享受的经济适用住房建筑面积标准一已有住房建筑面积)]×经济适用住房商品价 六、售房对象申请、认定、销售流程 (一)申请、认定 1、申请受理公告。由市经济适用住房建设办公室、市房改办不定期将公开销售的经济适用住房房源在《富阳日报》上公告，公告内容主要包括房源数量、地段、户型、价格、建设开发单位、申请受理的时间、准购对象范围等。 2、申请家庭填写《富阳市区购买经济适用住房》，经申请家庭成员各所在单位党组织、纪检部门负责人审核签字并加盖单位公章(无单位的，由各所在社区审核，街道办事处、乡镇政府确认，并加盖公章)后，送申请家庭所在单位、街道、社区分别进行公示，公示期为15天。经公示无异议的，由所在单位、街道、社区盖章确认后，报市房改办审批。市房改办对报送的材料进行初审，对符合初审条件的申请人出具受理凭证。 3、市房改办对申请家庭情况进行审查，经审查符合申购条件的，以登报和上网形式向社会公示，接受群众监督;经审查不符合申购条件的，市房改办出具“不予受理通知书’’。 4、市监察局、房改办会同申请人单位党组织、纪检部门对公示后举报情况进行调查、核实和处理。 5、市房改办会同相关部门对公示后符合申购条件的优先出售对象情况进行审查，经审查符合条件的，在《富阳日报》和政府门户网站上向社会公示，接受群众监督。市监察局、房改办会同相关部门对公示后举报情况进行调查、核实和处理。 6、申请人家庭须提供以下材料复印件并校验原件: (1)夫妻双方身份证复印件; (2)夫妻双方户口本复印件(含盖有富阳市公安局户口专用章并有房屋地址的首页)，夫妻双方户口不在同一户口本的，另需提供结婚证书复印件; advantages, facing the Yangtze River Delta, Pearl River Delta, Shandong peninsula, Beijing-Tianjin-Tangshan area, targeted investment promotion several times. Food research station platform, to the XX University to find experts (3)户口所在地住房、现住房和享受实物分房的住房产权证明或公房承租证明复印件，如属集体户口且无房的，由单位出具无房证明; (4)有职务的需提供任命文件复印件，有职称的需提供职称证书复印件及聘书(或证明)。 (5)优先出售对象还需提供市相关部门出具的证明。 (二)销售 1、入围。公示无异议或经查实符合购房申请条件的一般购房申请对象，为入围人员;公示无异议或经查实符合条件的优先出售对象，为优先准购对象。 2、摇号。经济适用住房通过实行电脑公开摇号的方式进行销售。市房改办将全部入围人员的身份证号码输入电脑，以随机抽取方式分别产生一般准购对象、预备对象。其中，一般准购对象与房源数(减去优先准购对象数后的剩余房源数，下同)的比例为1:1，预备对象与房源数的比例为1:0.25。然后，再将选出的一般准购对象和优先准购对象一起通过电脑选号产生选房顺序号。预备顺序号同样通过电脑选号形式产生。 、由准购对象、预备对象家庭成员所在部门、单位党组织、纪检部门负责3 人对准购对象、后备对象进行复核，并加盖单位公章(无单位的，由各所在社区审核，街道办事处、乡镇政府确认，并加盖公章)。 4、对经复核符合准购条件的准购对象和后备对象进行公示，接受社会监督。 5、市监察局、房改办对公示后举报情况进行调查、核实和处理。 6、公开选房。市房改办组织经公示查实符合准购条件的准购对象公开选房。经公示无异议或经查实符合准购条件的，市房改办按选房顺序号发放准购证，开具选房联系单，购房者凭市房改办出具的《准购证》、《富阳市购买经济适用住房选房联系单》，到市经济适用住房建设办公室办理购房手续。 7、领取《准购证》后放弃选房或选房后放弃购买的，《准购证》作废，需重新办理申请购房手续。由此造成的准购对象空缺，预备对象按预备顺序号的先后顺序替补为准购对象。 8、职工、居民购买经济适用住房，必须在房屋交付使用后18个月内入住，否则由建设单位收回所购住房，重新安排。经济适用住房的房屋所有权证须在购房户正式入住后才予办理(在购房合同中明确)。 9、对采取隐瞒、欺骗等手段骗购经济适用住房的，一经发现，立即撤销其有关手续、证件，由市经济适用住房建设办公室及时收回住房(在购房合同中明确)，并责令所在单位对申请人追究责任。对出具虚假证明的单位，由市住房改革委员会提请有关部门追究单位主要领导和相应责任人的责任。 advantages, facing the Yangtze River Delta, Pearl River Delta, Shandong peninsula, Beijing-Tianjin-Tangshan area, targeted investment promotion several times. Food research station platform, to the XX University to find experts 七、经济适用住房的换购 经济适用住房购买人以市场价出售经济适用住房后，不得再购买经济适用住房;如需换购，必须以届时经济适用住房价格出售给取得经济适用住房资格的家庭后，方可再次申请购买经济适用住房。原购买人可根据本细则规定的申购条件重新办理申请手续，重新核发《准购证》，原《准购证》号码予以作废。 八、经济适用住房建设单位在房屋建成后，应当按规定办理房屋产权初始登记，领取房屋所有权证、土地使用证，房屋、土地登记部门在房屋所有权证、土地使用证“附记”栏中注明“经济适用住房”。 居民个人购买经济适用住房后，应当按规定办理房屋转移登记，领取房屋所有权证和土地使用证，房屋登记部门在房屋所有权证“附记”栏中注明“经济适用住房”、所占面积、准予上市交易日期及相关的内容。土地登记部门在土地使用证“附证”栏中说明“经济适用住房，划拨土地”。 九、经济适用住房在取得房屋所有权证和土地使用证之日起，5年内不得上市交易、转让、出租。出售时，应当按照届时同地段普通商品住房与经济适用住房差价的一定比例向政府缴纳收益(具体办法另行制定)。个人购买的经济适用住房在向政府补缴收益前不得出租经营。凡将经济适用住房作为营业场所使用的，工商行政主管部门不得办理营业执照。 在限制上市交易期限内，因继承、离婚析产而发生房屋所有权转移的，经市房管处核准后，允许办理交易过户手续。办理交易过户手续后，房产性质仍为经济适用住房，限制上市交易期从原房屋所有权证办理之日起计算。房屋登记部门在“附记”中注明“经济适用住房继承”或“经济适用住房离婚析产”、所占面积、准予上市交易日期及相关的内容因法院裁定、判决、调解等必须发生房屋所有权转移的，经市房管处核准，按规定缴纳有关费用后，允许提前上市。 十、经济适用住房办理房屋所有权和土地使用权证时，房屋权属和土地权属登记部门根据市房改办确认的名单办理房屋所有权和土地使用权证;建设单位自行销售的经济适用住房，房屋权属和土地权属登记部门不得办理房屋所有权和土地使用权证。 十一、单位以集资、合作建房形式建设的单位自建经济适用住房，参照本细则的规定执行。 十二、本实施细则自公布之日起执行。本实施细则由富阳市住房制度改革办公室负责解释。 advantages, facing the Yangtze River Delta, Pearl River Delta, Shandong peninsula, Beijing-Tianjin-Tangshan area, targeted investment promotion several times.
