违章建筑论文：违章建筑 法律 完善 违章建筑论文:违章建筑 法律制度 完善 【中文摘要】在我国,违章建筑问已经阻碍和谐社会建设,引起社会广泛关注。违章建筑不仅影响城市容貌,妨碍城市发展规划的实施,还浪费资源,甚至对城市公共安全造成威胁,对我国公共事务管理提出了重大挑战。然而,我国尚未建立规范的处理违章建筑的法律制度。立法方面,尚无全国性统一规范违章建筑处理的专门立法,主要是各地按本地实际情况制定相关规定,因而立法制度不科学、不成体系;违章建筑监管主体,目前我国没有专门统筹监管违章建筑的机关,而是依不同的违章建设行为所违反的规范性法律由相关行政机关监管,因而往往不能有效监管,更遑论常态监管、事前监管;执法方面,我国实施地方政府领导组织、各职能部门各司其职的制度,方式单一,未全面考虑经济效益和社会效益,甚至发生一些冲突。造成这种局面的原因很多,其中很重要的原因是,我国在处理违章建筑法律制度立法方面存在不足。因此,本文从我国违章建筑立法现状及处理现状入手,力求完善我国处理违章建筑方面的制度。本文从违章建筑的概念和法律构成要件着手,指出我国处理违章建筑法律制度方面的现状和缺陷,结合我国国情提出从立法体系,执行、认定机制,行政处罚,监管制度及司法制度等方面完善我国处理违章建筑的法律制度,除引言、结语,拙文分为以下三章:第一章,违章建筑的基本理论。本章首先提出了违章建筑的定义,然后,指出违章建筑的法律构成要件是违法性和行政机关认定,最后阐述正确界定违章建筑的意义及违章建筑的类 型。第二章,我国处理违章建筑的现行法律制度。本章首先概述我国 违章建筑处理方面的现行法律;然后从行政执法、房屋拆迁中违章建 筑处理方面阐述我国违章建筑行政处理制度;最后分析我国处理违章 建筑法律制度存在的问题。第三章,完善我国处理违章建筑法律制度 的具体。本章提议建立体现中央和地方各级职能部门科学划分的 违章建筑立法与决策执行机制,设计区别违章建筑不同情形作出相应 处罚的制度,建立规范的违章建筑认定机制,设立专门违章建筑监管 主体和建立动态、长效、高科技的违章建筑监管制度。 【英文摘要】Illegal buildings in our country, the question has become social development, constructing the harmonious society, the social obstacles of attention.
