食品标识管理规定 第一章 总 则 第一条 为了加强对食品标识的监督管理，食品标识的标注，防止质量欺诈，保护企业和消费者合法权益，根据《中华人民共和国产品质量法》、《中华人民共和国食品卫生法》、《国务院关于加强食品等产品安全监督管理的特别规定》以及《中华人民共和国工业产品生产许可证管理条例》等法律法规，制定本规定。 第二条 在中华人民共和国境内生产(含分装)、销售的食品的标识标注和管理，适用本规定。 第三条 本规定所称食品标识是指粘贴、印刷、标记在食品或者其包装上，用以示食品名称、质量等级、商品量、食用或者使用、生产者或者销售者等相关信息的文字、符号、数字、图案以及其他的总称。 第四条 国家质量监督检验检疫总局(以下简称国家质检总局)在其职权范围内负责组织全国食品标识的监督管理工作。 县级以上地方质量技术监督部门在其职权范围内负责本行政区域内食品标识的监督管理工作。 第二章 食品标识的标注内容 第五条 食品或者其包装上应当附加标识，但是按法律、行政法规规定可以不附加标识的食品除外。 食品标识的内容应当真实准确、通俗易懂、科学合法。 第六条 食品标识应当标注食品名称。 食品名称应当表明食品的真实属性，并符合下列要求: (一)国家标准、行业标准对食品名称有规定的，应当采用国家标准、行业标准规定的名称; (二)国家标准、行业标准对食品名称没有规定的，应当使用不会引起消费者误解和混淆的常用名称或者俗名; (三)标注“新创名称”、“奇特名称”、“音译名称”、“牌号名称”、 “地区俚语名称”或者“商标名称”等易使人误解食品属性的名称时，应当在所示名称的邻近部位使用同一字号标注本条(一)、(二)项规定的一个名称或者分类(类属)名称; tape per meter, and then slowly into the hole. (2) cable protection 1) cable connection, Epoxy painted or at the cable connectors into the wax to prevent moisture penetration. 2) should strictly prevent the corrosion oil stain cables, keep the cables clean and dry. 3) cable in traction during excavation blasting, construction to prevent mechanical damage to the cables, welding and welding residue burned out cables, pipe (四)由两种或者两种以上食品通过物理混合而成且外观均匀一致难以相互分离的食品，其名称应当反映该食品的混合属性和分类(类属)名称; (五)以动、植物食物为原料，采用特定的加工工艺制作，用以模仿其他生物的个体、器官、组织等特征的食品，应当在名称前冠以“人造”、“仿”或者“素”等字样，并标注该食品真实属性的分类(类属)名称。 第七条 食品标识应当标注食品的产地。 食品产地应当按照行政区划标注到地市级地域。 第八条 食品标识应当标注生产者的名称和地址。生产者名称和地址应当是依法登记注册、能够承担产品质量责任的生产者的名称、地址。 有下列情形之一的，按照下列规定相应予以标注: (一)依法独立承担法律责任的公司或者其子公司，应当标注各自的名称和地址; (二)依法不能独立承担法律责任的公司分公司或者公司的生产基地，应当标注公司和分公司或者生产基地的名称、地址，或者仅标注公司的名称、地址; (三)受委托生产加工食品且不负责对外销售的，应当标注委托企业的名称和地址;对于实施生产许可证管理的食品，委托企业具有其委托加工的食品生产许可证的，应当标注委托企业的名称、地址和被委托企业的名称，或者仅标注委托企业的名称和地址; (四)分装食品应当标注分装者的名称及地址，并注明分装字样。 第九条 食品标识应当清晰地标注食品的生产日期和保质期。 食品的保质期与贮藏条件有关的，应当标注食品的特定贮藏条件。乙醇含量10%以上(含10%)的饮料酒、食醋、食用盐、固态食糖类，可以免除标注保质期。 日期的标注方法应当符合国家标准规定或者采用“年、月、日”表示。 第十条 定量包装食品标识应当标注净含量。对含有固、液两相物质的食品，除标示净含量外，还应当标示沥干物(固形物)的含量。 净含量应当与食品名称排在食品包装的同一展示版面。净含量的标注应当符合《定量包装商品计量监督管理办法》的规定。 第十一条 食品标识应当标注食品的配料清单。 配料清单中各种配料应当按照生产加工食品时加入量的递减顺序进行标注，具体标注方法按照国家标准的规定执行。 在食品中直接使用甜味剂、防腐剂、着色剂的，应当在配料清单食品添加剂项下标注具体名称;使用其他食品添加剂的，可以标注具体名称、种类或者代码。tape per meter, and then slowly into the hole. (2) cable protection 1) cable connection, Epoxy painted or at the cable connectors into the wax to prevent moisture penetration. 2) should strictly prevent the corrosion oil stain cables, keep the cables clean and dry. 3) cable in traction during excavation blasting, construction to prevent mechanical damage to the cables, welding and welding residue burned out cables, pipe 食品添加剂的使用范围和使用量应当按照国家标准的规定执行。 第十二条 食品标识应当标注企业所执行的国家标准、行业标准、地方标准号或者经备案的企业标准号。 第十三条 食品执行的标准明确要求标注食品的质量等级、加工工艺的，应当相应地予以标明。 第十四条 实施生产许可证管理的食品，食品标识应当标注食品生产许可证编号及QS标志。 委托生产加工实施生产许可证管理的食品，委托企业具有其委托加工食品生产许可证的，可以标注委托企业或者被委托企业的生产许可证编号。 第十五条 混装非食用产品易造成误食，使用不当，容易造成人身伤害的，应当在其标识上标注警示标志或者中文警示说明。 第十六条 食品有以下情形之一的，应当在其标识上标注中文说明: (一)医学临床证明对特殊群体易造成危害的; (二)经过电离辐射或者电离能量处理过的; (三)属于转基因食品或者含法定转基因原料的; (四)按照法律、法规和国家标准等规定，应当标注其他中文说明的。 第十七条 食品在其名称或者说明中标注“营养”、“强化”字样的，应当按照国家标准有关规定，标注该食品的营养素和热量，并符合国家标准规定的定量标示。 第十八条 食品标识不得标注下列内容: (一)明示或者暗示具有预防、治疗疾病作用的; (二)非保健食品明示或者暗示具有保健作用的; (三)以欺骗或者误导的方式描述或者介绍食品的; (四)附加的产品说明无法证实其依据的; (五)文字或者图案不尊重民族习俗，带有歧视性描述的; (六)使用国旗、国徽或者人民币等进行标注的; (七)其他法律、法规和标准禁止标注的内容。 第十九条 禁止下列食品标识违法行为: (一)伪造或者虚假标注生产日期和保质期; (二)伪造食品产地，伪造或者冒用其他生产者的名称、地址; (三)伪造、冒用、变造生产许可证标志及编号; (四)法律、法规禁止的其他行为。 tape per meter, and then slowly into the hole. (2) cable protection 1) cable connection, Epoxy painted or at the cable connectors into the wax to prevent moisture penetration. 2) should strictly prevent the corrosion oil stain cables, keep the cables clean and dry. 3) cable in traction during excavation blasting, construction to prevent mechanical damage to the cables, welding and welding residue burned out cables, pipe 第三章 食品标识的标注形式 第二十条 食品标识不得与食品或者其包装分离。 第二十一条 食品标识应当直接标注在最小销售单元的食品或者其包装上。 第二十二条 在一个销售单元的包装中含有不同品种、多个独立包装的食品，每件独立包装的食品标识应当按照本规定进行标注。 透过销售单元的外包装，不能清晰地识别各独立包装食品的所有或者部分强制标注内容的，应当在销售单元的外包装上分别予以标注，但外包装易于开启识别的除外;能够清晰地识别各独立包装食品的所有或者部分强制标注内容的，可以不在外包装上重复标注相应内容。 第二十三条 食品标识应当清晰醒目，标识的背景和底色应当采用对比色，使消费者易于辨认、识读。 第二十四条 食品标识所用文字应当为规范的中文，但注册商标除外。 食品标识可以同时使用汉语拼音或者少数民族文字，也可以同时使用外文，但应当与中文有对应关系，所用外文不得大于相应的中文，但注册商标除外。 第二十五条 食品或者其包装最大表面面积大于20平方厘米时，食品标识中强制标注内容的文字、符号、数字的高度不得小于1.8毫米。 食品或者其包装最大表面面积小于10平方厘米时，其标识可以仅标注食品名称、生产者名称和地址、净含量以及生产日期和保质期。但是，法律、行政法规规定应当标注的，依照其规定。 第四章 法律责任 第二十六条 违反本规定第五条第一款，食品或者其包装上未附加标识的，责令限期改正，处以1万元以下罚款。 第二十七条 违反本规定第六条至第八条、第十一条至第十三条，未按规定标注应当标注内容的，责令限期改正;逾期不改的，处以500元以上1万元以下罚款。 第二十八条 违反本规定第九条、第十五条，未按规定标注生产日期和保质期、警示标志或中文警示说明的，依照《中华人民共和国产品质量法》第五十四条规定进行处罚。 第二十九条 违反本规定第十条，未按规定标注净含量的，依照《定量包装商品计量监督管理办法》规定进行处罚。 第三十条 实施生产许可证管理的食品，其标识未标注生产许可证编号及标tape per meter, and then slowly into the hole. (2) cable protection 1) cable connection, Epoxy painted or at the cable connectors into the wax to prevent moisture penetration. 2) should strictly prevent the corrosion oil stain cables, keep the cables clean and dry. 3) cable in traction during excavation blasting, construction to prevent mechanical damage to the cables, welding and welding residue burned out cables, pipe 志的，依照《中华人民共和国工业产品生产许可证管理条例》第四十七条规定进行处罚。 伪造、冒用、变造生产许可证编号及标志的，依照《中华人民共和国工业产品生产许可证管理条例》第五十一条规定进行处罚。 第三十一条 违反本规定第十七条，未按规定标注食品营养素、热量以及定量标示的，责令限期改正;逾期不改的，处以5000元以下罚款。 第三十二条 违反本规定第十八条，食品标识标注禁止性内容的，责令限期改正;逾期不改的，处以1万元以下罚款;违反有关法律法规规定的，按有关法律法规规定处理。 第三十三条 伪造或者虚假标注食品生产日期和保质期的，责令限期改正，处以500元以上1万元以下罚款;情节严重，造成后果的，依照有关法律、行政法规规定进行处罚。 第三十四条 伪造食品产地，伪造或者冒用其他生产者的名称、地址的，依照《中华人民共和国产品质量法》第五十三条规定进行处罚。 第三十五条 违反本规定第二十条，食品标识与食品或者其包装分离的，责令限期改正，处以5000元以下罚款。 第三十六条 违反本规定第二十一条、第二十二条第二款、第二十四条、第二十五条的，责令限期改正;逾期不改的，处以1万元以下罚款。 第三十七条 违反本规定第二十二条第一款的，依照本章有关规定处罚。 第三十八条 从事食品标识监督管理的工作人员，玩忽职守、滥用职权、包庇放纵违法行为的，依法给予行政处分;构成犯罪的，依法追究刑事责任。 第三十九条 本规定规定的行政处罚由县级以上地方质量技术监督部门在职权范围内依法实施。 法律、行政法规对行政处罚另有规定的，依照其规定。 第五章 附 则 第四十条 进出口食品标识的管理，由出入境检验检疫机构按照国家质检总局有关规定执行。 第四十一条 本规定由国家质检总局负责解释。 第四十二条 本规定自2008年9月1日起施行。原国家技术监督局公布的《查处食品标签违法行为规定》同时废止。 tape per meter, and then slowly into the hole.
