EREF_Toc350951182\h135基本要求和功能满足PAGEREF_Toc350951183\h135证明的出具人PAGEREF_Toc350951184\h136证明的内容PAGEREF_Toc350951185\h136先期Preliminaryconsideration，可译为“预先注意事项”，有点长。这里译为“先期事项”，含义不变，但更简洁，便于交流。事项PreliminaryConsiderations适用范围ScopeofthepublicationParaI:ThispublicationistobereadinconjunctionwithUCP600andnotinisolation.本出版物应当结合UCP600进行解读，不应孤立解读。ParaII:ThepracticesdescribedinthispublicationhighlighthowthearticlesofUCP600aretobeinterpretedandapplied,totheextentthatthetermsandconditionsofthecredit,oranyamendmentthereto,donotexpresslymodifyorexcludeanapplicablearticleinUCP600.本出版物所描述的实务，强调了UCP600所适用的条款在信用证或有关的任何修改书没有明确修改或排除的范围内，如何解释和适用。信用证和修改的申请、信用证开立及修改Thecreditandamendmentapplication,theissuanceofthecreditandanyamendmenttheretoParaIII:Thetermsandconditionsofacreditandanyamendmenttheretoareindependentoftheunderlyingsaleorothercontractevenifthecreditoramendmentexpresslyreferstothatsaleorothercontract.Whenagreeingthetermsofthesaleorothercontract,thepartiestheretoshouldbeawareoftheensuingimplicationsforthecompletionofthecreditoramendmentapplication.信用证和有关的任何修改书的条款与条件独立于基础销售合同或其它合同，即便信用证或修改书明确提及了该销售合同或其它合同。在约定销售合同或其它合同条款时，有关各方应当意识到其对完成开证或修改申请的影响。ParaIV:Manyoftheproblemsthatariseatthedocumentexaminationstagecouldbeavoidedorresolvedbytherespectivepartiesthroughcarefulattentiontodetailinthecreditoramendmentapplicationandissuanceofcreditoranyamendmentthereto.Theapplicantandbeneficiaryshouldcarefullyconsiderthedocumentsrequiredforpresentation,bywhomtheyaretobeissued,theirdatacontentandthetimeframeinwhichtheyaretobepresented.如果对开证或修改申请、和信用证开立或有关的任何修改的细节予以谨慎注意，审单阶段出现的许多问题都能够得以避免或解决。开证申请人和受益人应当审慎考虑所要求提交的单据、单据由谁出具、单据的数据内容和提交单据的期限。ParaV:Theapplicantbearstheriskofanyambiguityinitsinstructionstoissueoramendacredit.Anissuingbankmay,unlesstheapplicantexpresslyinstructstothecontrary,supplementordevelopthoseinstructionsinamannernecessaryordesirabletopermittheuseofthecreditoranyamendmentthereto.Anissuingbankshouldensurethatanycreditoramendmentitissuesisnotambiguousorconflictinginitstermsandconditions.开证申请人承担其开立或修改信用证的指示模糊不清带来的风险。在申请人没有明确表示相反意见的情况下，开证行可以必要或合适的方式补充或细化那些指示，以便信用证或有关的任何修改书得以使用。开证行应当确保其所开立的任何信用证或修改书的条款与条件没有模糊不清，也没有互相矛盾。ParaVI:TheapplicantandissuingbankshouldbefullyawarethecontentofUCP600andrecognizethatarticlessuchas3,14,19,20,21,23,24,28(i),30and31definetermsinamannerthatmayproduceunexpectedresults.Forexample,acreditrequiringpresentationofabillofladingandcontainingaprohibitionagainsttranshipmentwill,inmostcases,havetoexcludeUCP600sub-article20(c)tomaketheprohibitionagainsttranshipmenteffective.开证申请人和开证行应当充分了解UCP600的内容，并认识到其中的诸如第3条、第14条、第19条、第20条、第21条、第23条、第24条、第28条i款、第30条和第31条等条款的约定方式，可能产生出乎预料的结果。例如，在多数情况下，信用证要求提交提单且禁止转运时必须排除UCP600第20条c款的适用，才能使信用证规定的禁止转运发生效力。ParaVII:Acreditoranyamendmenttheretoshouldnotrequirepresentationofadocumentthatistobeissued,signedorcountersignedbytheapplicant.If,nevertheless,acreditoramendmentisissuedincludingsucharequirement,thebeneficiaryshouldconsidertheappropriatenessofsucharequirementanddetermineitsabilitytocomplywithit,orseekasuitableamendment.信用证或有关的任何修改书不应要求提交由开证申请人出具、签署或副签的单据。如果开立的信用证或修改书还是含有此类要求，那么受益人应当考虑其合理性，并判断满足该要求的能力，或者寻求适当的修改。总则GeneralPrinciples缩略语AbbreviationsParaA1:Generallyacceptedabbreviations,suchas,butnotlimitedto,“Int’l”insteadof“International”,“Co.”insteadof“Company”,“kgs”or“kos.”insteadof“kilograms”or“kilos”,“Ind”insteadof“Industry”,“Ltd”insteadof“Limited”,“mfr”insteadof“manufacturer”or“mt”insteadof“metrictons”maybeusedindocumentsinsubstitutionforawordorviceversa.Acreditthatincludesanabbreviationinitstextallowsadocumenttoshowthesameabbreviationoranyotherabbreviationthathasthesamemeaning,ortoshowthecompletespellingofthewordorviceversa.普遍接受的缩略语可以在单据上替代其全称，比如Forexample,可译为“比如”和“例如”，均为书面语，含义相同。但“比如”音较轻，属于平音，适宜放句中。“例如”音重，属于“仄”音，适宜放句首。全文照此统一。但不限于，用“Int’l”代替“International（国际）”，用“Co.”代替“Company（公司）”，用“kgs”或“kos.”代替“kilograms（千克）”或“kilos（千克、千米）”，用“Ind”代替“Industry（工业）”，用“Ltd.”代替“Limited（有限）”，用“mfr”代替“manufacturer（制造商）”，用“mt”代替“metrictons（公吨）”，反之亦然。信用证文本中使用缩略语，即允许单据上使用同样的缩略语或具有同一含义的其它缩略语，或使用其全称，反之亦然。ParaA2：a.Virgules(i.e.,slashmarks“/”)mayresultindifferentmeaningsandshouldnotbeusedasasubstituteforaword.Ifnevertheless,avirguleisusedandnocontextisapparent,thiswillallowtheuseofoneormoreoftheoptions.Forexample,aconditioninacreditstating“Red/Black/Blue”withnofurtherclarificationwillmeanonlyRedoronlyBlackoronlyBlueoranycombinationofthem.斜线（“/”）可能导致不同的含义，不应用来替代词语。尽管如此，如果还是使用了斜线，且上下文含义不明，那么将允许使用其中的一个或多个选择。例如，信用证规定了“红/黑/蓝”，且没有进一步说明，这表示颜色可以只是红或只是黑或只是蓝，或它们的任何一种组合。b.Theuseofacommawhenindicatingarangeofdatainacreditsuchasportsofloadingordischargeorcountriesoforigin,mayresultindifferentmeaningsandshouldnotbeusedasasubstituteforaword.If,nevertheless,acommaisusedandnocontextisapparent,thiswillallowtheuseofoneormoreoftheoptions.Forexample,whenacreditallowspartialshipmentandindicatestheportofloadinginformationas“Hamburg,Rotterdam,Antwerp”withnofurtherclarification,thiswillmeanonlyHamburgoronlyRotterdamoronlyAntwerporanycombinationofthem.逗号用来表明信用证中的数据范围，如装货港或卸货港或原产地所在国时，可能导致不同的含义，不应用来替代词语。尽管如此，如果还是使用了逗号，且上下文含义不
